# AI video commercial use: Kling, Seedance, Hailuo terms

AI video commercial use depends on plan and route: Kling and Hailuo allow it on paid plans, Dreamina says private use. Each generator's terms, read and dated.

## Key points

- Kling's free plan does not allow commercial use without written permission. Kling members and Kling API customers may use the output commercially.
- Buying Kling credits without a membership does not add commercial rights: the credit rules forbid using credits for profit.
- Dreamina's terms describe its services, Seedance included, as generally for private, non-commercial use.
- Hailuo allows commercial use of videos made and downloaded on a paid plan. Through a reseller, WaveSpeed sends you back to the model maker's terms.
- A commercial licence covers the output. It does not cover a real person's face, someone else's dance clip or music you upload.

---
You can use AI video commercially if you are on the right plan and read the right document. Kling allows it for paying members and API customers, but not on the free plan without written permission. Hailuo allows it for videos made on a paid plan. Dreamina, where most people use Seedance, calls its services private and non-commercial.

Most pages about this quote one sentence from a pricing page. Below are the terms themselves, read on 5 October 2026, with the clause that decides each case.

## Which AI video generators allow commercial use

The answer changes with two things: the plan you were on when you made the clip, and the way you reached the model. That can be the app, the maker's own API or a reseller. Find your row first.

_Whether you may sell a clip depends on the plan you were on when you made it and on the route you used. Find your row, then read the clause in the section below. (Generator terms quoted in this article, checked 2026-10-05)_

| Generator | Free plan in the app | Paid plan in the app | API or reseller |
| --- | --- | --- | --- |
| Kling (Kling app, Kling API) | not allowed: Not without written permission, and the Kling brand must stay on the video | allowed, with a condition: Members only. Credits bought on their own may not be used for profit | allowed: Commercial use "not restricted" in the API terms |
| Hailuo and MiniMax (Hailuo app, MiniMax API) | not stated or unclear: Watermarked downloads. No commercial grant for free users | allowed, with a condition: For videos made and downloaded while on a paid plan | allowed, with a condition: You keep ownership. You must add a visible AI mark |
| Seedance (Dreamina app, BytePlus ModelArk API) | not allowed: Terms say private, non-commercial use | not stated or unclear: Only under extra terms "if permitted", which we could not find | allowed, with a condition: You own the output. Not available in the US |
| Higgsfield (Reseller: Kling, Seedance and others) | allowed: Not tied to a plan. Free plans may carry a watermark | allowed: Rights in exported clips survive cancelling | Not covered here |
| WaveSpeed (Reseller: Kling, Seedance and others) | Pay per use, no app plans | Pay per use, no app plans | not stated or unclear: Depends on the model maker's licence |

On every row: the licence covers the output, not what you upload. A real face, someone else's clip or unlicensed music is still your problem, and you still label the video as AI.

Two rows surprise people. Kling's main terms read like a ban on commercial use, but a second document lifts it for members. And Dreamina, ByteDance's own app, is stricter than the ByteDance API.

## Kling AI commercial use: the free plan says no, members say yes

- **Free plan:** no commercial use without Kling's written permission, and the Kling brand stays on the video.
- **Membership:** commercial use is "not restricted".
- **Credits bought without a membership:** not for profit.
- **Kling API:** commercial use is "not restricted".

On Kling, the Terms of Service and the Terms of Paid Service say different things. You need both.

> Last updated 2026/04/21. Section 4.6: "without our written permission, you may not use, reproduce, distribute, and create derivative works of, and make modifications to, the Output for any commercial purposes." Section 4.5: without written permission, you "shall label the Output interface with the brand and logo involved (including but not limited to "Kling AI" […])". Section 4.7.1 gives Kling "an non-exclusive, royalty-free right and license" to use your Input and Output, and 4.7.4 says you can revoke it "by sending an email to support@kling.ai".
>
> — Source: Kling AI — Terms of Service, read 2026-10-05 — https://kling.ai/docs/user-policy

> Release date 2026/04/21. Section 3.1.2 lists membership benefits, including watermark removal and: "KLING AI members' use of the Output for commercial purposes is not restricted. You are permitted to use, reproduce, distribute, make modifications to, and create derivative works of, the Output for any commercial purpose (except for the purposes of developing or offering competitive products or services of KLING AI)." Section 4.1.4: "You may not acquire/use the Credit for any non-personal use such as for profit".
>
> — Source: Kling AI — Terms of Paid Service, read 2026-10-05 — https://kling.ai/docs/payment-policy

Pricing blogs that say "a paid Kling plan allows commercial use" are right if "paid plan" means a membership. If you read only the Terms of Service, you would think Kling bans it for everyone.

Watch the credits. A membership comes with credits and gives you the commercial right. Credits you buy on their own do not: section 4.1.4 rules out using them for profit. If your persona earns money, buy a membership, not only a credit pack.

> Release date 2026-04-21. Section 6.4: "You use of the AI-generated content for commercial purposes is not restricted." Kling adds that AI content "cannot completely avoid the risk of infringement of intellectual property rights" and asks you to "carefully evaluate before using it for external commercial purposes."
>
> — Source: Kling AI — Terms of API Paid Service, read 2026-10-05 — https://kling.ai/document-api/guides/protocols/paid-service

The API terms are simpler. If you pay for Kling's API directly, commercial use is open. The [AI video models overview](https://aiofmcity.com/blog/ai-video-models-for-personas) compares what Kling costs against the other video models.

## Is Seedance free for commercial use?

No, not in Dreamina, ByteDance's own app. Through ByteDance's API for businesses, BytePlus ModelArk, you own the output and pay per use.

- **Dreamina, free or paid:** treat it as private use. The terms say "private, non-commercial", and the commercial terms they mention are not published.
- **BytePlus ModelArk API:** you own the output. The service is not available in the United States.
- **Seedance through an aggregator:** BytePlus says the aggregator's users may only make video for their own use.

> Last updated January 22, 2026: "Our Services are generally provided for private, non-commercial use." You "may also be subject to additional terms and policies for […] your access or use of the certain content for commercial purposes (if permitted)." As a condition of use, you agree not to "access or use the Services or any content therein for any commercial or unauthorized purposes." If you comply with the Terms, "you own the Inputs you upload, and the Outputs generated in response", and you grant the company and other users a "perpetual, irrevocable, worldwide" licence to use them "for any purpose".
>
> — Source: Dreamina — Terms of Service, read 2026-10-05 — https://dreamina.capcut.com/clause/dreamina-terms-of-service?lang=en

We could not find the "additional terms" for commercial use that Dreamina mentions. A Dreamina guide to its paid plans says it "supports commercial creation subject to applicable terms, plan or model conditions". It links only to the general terms quoted above. The pricing page does not split commercial rights by plan either.

> FAQ "Can I use Dreamina creations for commercial purposes?": "Commercial-use eligibility depends on the applicable Dreamina terms, the content you create, and the models or assets involved. Before using Dreamina-generated content commercially, review the latest Terms of Service and relevant usage requirements." The page lists Free, Basic, Standard, Advanced and Ultra plans and names no commercial right for any of them.
>
> — Source: Dreamina — Pricing, read 2026-10-05 — https://dreamina.capcut.com/pricing/dreamina-price

So a paid Dreamina plan buys credits, not a commercial licence. Until Dreamina publishes the extra terms, treat Seedance in Dreamina as private use.

> Last updated August 28, 2026. "As between you and BytePlus, you retain your rights in Input. To the extent permitted by applicable law, as between you and BytePlus, you own the Output generated in response to your Input, and BytePlus does not claim ownership of such Output." You must comply with "any applicable labeling or disclosure requirements for AI-generated content", and you are responsible for "any rights relating to a person's likeness, image, or voice."
>
> — Source: BytePlus — General Terms for AI Services, read 2026-10-05 — https://docs.byteplus.com/en/docs/legal/AI-Services-terms

> Last updated September 30, 2026. "The BytePlus Model Services are not available in the United States." A platform that resells BytePlus video generation to creators must have identity verification and "processes to verify and retain rights in user-uploaded content, including real-person imagery". "If you operate an aggregation platform, end users may only generate video content for their own use".
>
> — Source: BytePlus — Service Specific Terms, read 2026-10-05 — https://docs.byteplus.com/en/docs/legal/docs-service-specific-terms

For a persona business the ModelArk API is the cleaner route: you own the output, and nothing in these terms limits commercial use. It needs an API key and a little code. If you use Seedance through an aggregator instead, the last line applies to you: BytePlus limits what the aggregator's users may do with the video.

## Hailuo AI commercial use, and the MiniMax API

Hailuo is MiniMax's video app. Its terms are separate from the terms for MiniMax's API.

- **Free plan:** watermarked downloads and no commercial grant.
- **Paid plan:** you may use videos commercially that you made and downloaded while subscribed.
- **MiniMax API:** you keep ownership of the output, and you must put a visible AI mark on it.

> Last updated 7/14/2025. "Free Users: Video downloads will include a watermark." "We do not claim ownership over content you generate and download while on a paid subscription plan. As between you and us, you retain any and all intellectual property rights to such content, including the right to use it for commercial purposes."
>
> — Source: Hailuo AI — Video Subscription Service Terms, read 2026-10-05 — https://hailuoai.video/doc/payment-policy.html

> Last modified 08/19/2026. "When you publish, share, display, distribute, or otherwise make User Generated Content available to others, you must clearly disclose that it is AI-generated or manipulated whenever required by applicable law or reasonably necessary to avoid deception". "You must not remove, obscure, alter, or disable any watermark, metadata, label, or other notice applied by the Company to identify content as AI-generated or manipulated, except where expressly permitted by the Company in writing or required by applicable law."
>
> — Source: Hailuo AI — Terms of Service, read 2026-10-05 — https://hailuoai.video/doc/terms-of-service.html

So on Hailuo, pay before you make the videos you want to sell. The grant covers content generated "while on a paid subscription plan". The subscription terms are older than the main terms and still name the Hailuo02 model, so check the date again before you rely on them.

> Effective March 30, 2026. "As between you and us, and to the extent permitted by applicable laws, you retain your ownership rights in Client input and generated content." If you offer services based on its deep synthesis technology, you must "place a prominent mark in reasonable positions or areas within generated or edited content to inform the public of the use of deep synthesis technology."

## Through Higgsfield or WaveSpeed: whose terms apply?

When you use Kling or Seedance through a reseller, the reseller's terms apply first. The two resellers this site reviews handle the maker's terms in opposite ways.

- **Higgsfield:** its help page allows commercial use on every plan, and the rights stay after you cancel. Its pricing table disagrees for the Free plan.
- **WaveSpeed:** it depends on the model maker's licence, so you read the maker's terms as well.

> Last modified September 12, 2026. "Higgsfield does not claim ownership of your inputs or outputs, and does not restrict the commercial use of outputs". "The Terms of Use do not tie commercial use rights to a specific plan." "Rights in outputs you've generated and exported survive cancellation and account deletion". You "may not upload or use an image of another person without that person's permission (Section 5.3)."

> FAQ "Can I use Kling v3.0 Std Motion Control outputs commercially?": "Commercial usage rights depend on the model's license, set by its provider (Kuaishou). Check the provider's applicable terms and WaveSpeedAI's Terms of Service before commercial use."
>

> Last updated September 28, 2026. Section 11.1: the customer "owns and will continue to own all rights, title, and interest" in its Customer Data, which includes Outputs. Section 6.1: "You are responsible for complying with all Third-Party Terms and WaveSpeedAI is not, and will not be deemed to be, a party to any separate Third-Party Terms".
>
> — Source: WaveSpeedAI — Terms of Service, read 2026-10-05 — https://wavespeed.ai/static/terms

Higgsfield's help page gives you a clear answer, but its own pricing table marks commercial use as not included on the Free plan. Make anything you plan to sell on a paid plan. WaveSpeed sends you to the model maker, and it does not say which Kling document applies to its customers. Save a copy of the model page and the date you checked it. The reviews of [Higgsfield](https://aiofmcity.com/tools/higgsfield) and [WaveSpeed](https://aiofmcity.com/tools/wavespeed) cover prices and the other rules, and [model prices](https://aiofmcity.com/model-prices) lists what each clip costs today.

## What a commercial licence does not cover

A commercial grant covers the output against the tool. It does not clear what you put in, and it does not label the video for you.

> Section 4.3: "You warrant and undertake that you hold the intellectual property rights to the Input or that you have obtained legal authorization from the relevant owner to the use of the Input and that your use of the Input shall not violate any applicable laws and regulations or infringe upon the legitimate rights and interests of any third parties (including, without limitation, copyright, patent, trademark and other intellectual property rights and personality rights […])".
>
> — Source: Kling AI — Terms of Service, read 2026-10-05 — https://kling.ai/docs/user-policy

Three things stay your job on every plan:

1. **Your inputs.** A real person's photo as a face reference, a dance clip from someone else's account as a motion reference, or a song you did not license is not covered. Every tool above puts that on you. Use your own invented persona and footage you recorded yourself.
2. **The label.** Hailuo, MiniMax and BytePlus all tell you to label AI content where the law asks for it. Paying for a watermark-free download does not remove that duty. The [AI label matrix](https://aiofmcity.com/ai-label-matrix) shows what each platform wants.
3. **Who owns the video.** "You own the output" means the tool makes no claim. It does not mean a court would grant you a copyright in a clip made from a prompt. The [risk guide](https://aiofmcity.com/guides/risk-bans-and-recovery#who-owns-your-ai-persona-and-what-to-do-when-someone-copies-it) explains what you can protect instead.

Keep the provenance data in your files as well. Hailuo forbids removing its watermark or metadata without permission, and [don't strip your watermarks](https://aiofmcity.com/blog/dont-strip-your-watermarks-provenance) shows how to check that your export keeps it.

### What the sources do not say: Finding whether Kling's commercial right survives the end of a membership

Kling lists commercial use as a membership benefit. We looked for what happens to videos you made as a member after the membership ends. Kling's documents do not say.

Section 3.1.5 of the Terms of Paid Service says that after the validity period your account "will be restored to a Regular Account" and "you will not be able to continue to have the corresponding membership benefits". It does not say whether that covers videos you generated while you were a member. Section 4.6 of the Terms of Service, which forbids commercial use without written permission, has no exception for past member output either.

Other tools answer this. Higgsfield's help page says rights in exported outputs survive cancellation. Hailuo ties its grant to content made "while on a paid subscription plan".

You can check this yourself. Open kling.ai/docs/payment-policy and read sections 3.1.2 and 3.1.5. Then open kling.ai/docs/user-policy and read section 4.6. Search both for "expir", "cancel" and "after".

Until Kling answers it, keep your Kling invoices with the dates of each video, and ask Kling support for written confirmation before you sell older clips after cancelling.

## Five checks before you sell AI video

Work through these once per generator, and again when its terms get a new date.

**Before you sell an AI video**

- [ ] Find the document that grants commercial use — On Kling and Hailuo it is the paid-service or subscription terms, not the main terms. Note the date at the top.
- [ ] Pay before you generate — Kling's right comes with a membership, not with credits. Hailuo's covers content made while on a paid plan.
- [ ] Know your route — The app, the maker's API and a reseller each have their own terms. Through WaveSpeed, read the maker's terms as well. In Dreamina, wait for the commercial terms it mentions.
- [ ] Clear your inputs — Only your own persona, your own footage and licensed music. No real person's face without written consent.
- [ ] Label the video and keep the metadata — Every commercial right above still expects you to say the content is AI.

If you are still choosing a model, start with the [AI video models overview](https://aiofmcity.com/blog/ai-video-models-for-personas). If you want to start without paying, [making an AI influencer for free](https://aiofmcity.com/blog/make-an-ai-influencer-for-free) explains which free licences allow business use.

This article reads published terms with dates. It is general information, not legal advice. If a large deal depends on one clause, have a lawyer read it.

## Frequently asked

### Can I use Kling AI videos commercially on the free plan?

Not without Kling's written permission. Kling's Terms of Service say that without written permission you may not use the output for any commercial purpose. Its Terms of Paid Service lift that for members: their commercial use of the output "is not restricted".

### Is Seedance free for commercial use?

It depends on where you run it. Dreamina's terms say its services are generally for private, non-commercial use, and that commercial use needs additional terms "if permitted". Through the BytePlus ModelArk API you own the output, but you pay per use and the service is not available in the United States.

### Can I use Hailuo AI videos commercially?

Yes, for videos you make and download on a paid plan. Hailuo's subscription terms say you keep all rights to that content, including the right to use it commercially. The free plan has no such grant.

### If I use Kling through WaveSpeed or Higgsfield, whose terms apply?

The reseller's terms always apply, and WaveSpeed adds the model maker's terms on top: it says commercial rights depend on the licence set by the provider. Higgsfield's own help page says commercial use is allowed on all its plans, but its pricing table marks it as not included on the Free plan.

### Do I own an AI video I generated?

Against the tool, usually yes: Kling, BytePlus, MiniMax and Higgsfield all say they do not claim ownership of your output. Whether anyone can hold a copyright in it is a separate legal question. A commercial licence also does not cover the faces, motion clips or music you upload.
